By accessing and using GameGains ("the Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and others who access or use the Platform. We reserve the right to update these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

GameGains is a platform designed to provide perpetual futures trading on digital gaming assets, including but not limited to CS2 skins, TF2 items, OSRS gold, and other virtual gaming items.

The Platform is currently in development, and features described on our website represent our planned functionality. Access to certain features may be limited during our beta and early access phases.

To use GameGains, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be a resident of any jurisdiction where the use of our services is prohibited
• Not be on any sanctions list or prohibited from engaging in financial transactions

To access certain features of the Platform, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Risk Disclosure: Trading perpetual futures and leveraged products carries significant risk. You may lose some or all of your invested capital. Past performance is not indicative of future results.

Leverage: The Platform may offer leverage up to 10x. Leverage amplifies both potential profits and potential losses. You should only trade with funds you can afford to lose.

No Investment Advice: Nothing on the Platform constitutes financial, investment, legal, or tax advice. You should consult with appropriate professionals before making any trading decisions.

You agree not to engage in any of the following prohibited activities:

• Market manipulation, including wash trading, spoofing, or layering
• Using automated systems or bots without explicit authorization
• Circumventing any security measures or access controls
• Engaging in money laundering or terrorist financing activities
• Using the Platform for any illegal purpose
• Interfering with or disrupting the Platform's infrastructure
• Impersonating any person or entity
• Accessing accounts belonging to others without authorization

The Platform and its original content, features, and functionality are owned by GameGains and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

By submitting content to the Platform (including but not limited to feedback, suggestions, and communications), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEGAINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content
• Trading losses or liquidation of positions

You agree to indemnify, defend, and hold harmless GameGains and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
